These Terms and Conditions ("Terms") are a binding legal agreement between you and Crewscapes and govern your right to use the websites, applications, and other offerings supplied by Crewscapes (collectively, the "Platform"). When used in these Terms, "Crewscapes," "we," "us," or "our" refers to Crewscapes LLC, a corporation formed under the laws of the State of Delaware. Crewscapes provides users with a one-stop shop to book end-to-end boutique bachelorette trips in sought-after travel destinations across the United States. Please read these Terms carefully before interacting with our website at crewscapes.my.canva.site or otherwise use any other portion of the Platform. These Terms contain important information regarding your use of the Platform and limitations of our liability. Your access to and use of the Platform is conditional upon your acceptance of and compliance with these Terms. These Terms apply to all users of the Platform. The term "user" refers to anyone accessing or using the Platform. If you disagree with any part of these Terms, then you do not have our permission to access or use the Platform. Please refer to our Privacy Policy for a description of how we collect, use, and disclose data about our users. NOTE: THESE TERMS CONTAIN PROVISIONS THAT AFFECT YOUR RIGHTS CONCERNING DISPUTES YOU MAY HAVE WITH US. Your Responsibilities and Assumption of Risk The Platform. The Platform may contain links to third-party Vendor and Experience websites, applications, services, or resources. You acknowledge and agree that we have no responsibility or liability for the acts or omissions of any person or entity related to any Vendor or Experience. We provide a platform to facilitate bookings between users on the one hand and Vendors and Experiences on the other. The Vendors and Experiences may be subject to different terms and privacy practices. You agree that we are not responsible for any Vendors or Experience's terms, actions, or practices, and do not verify any Vendors or Experience's compliance with applicable laws, regulations, or policies. We have no responsibility or liability for acts or omissions by any Vendor or Experience and links to such Vendors or Experiences are not an endorsement. Your Responsibilities. You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Vendor or Experience. You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the Platform, including your involvement with any Vendor or participation in any Experience, or interaction with the Platform. For example, an Experience may carry the risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Experiences. You acknowledge and agree that Crewscapes will have no liability with respect to any incident occurring with a Vendor or Experience. Purchases For e-Commerce and when payment is required on the Platform, you will be using a third-party payment processor that will collect your payment information and process your payment. We are not responsible for the collection, use, sharing, or security of your billing information by such third-party payment processor. Payments must be made in the payment method(s) accepted by the third-party payment processor. You hereby represent and warrant that you have the legal right to use the payment method(s) in connection with any purchase and that the information you supply to us and the third-party payment processor(s) is true, correct, and complete. We reserve the right to cancel your purchase for any reason, at our sole discretion, including but not limited to fraud, inaccuracies, and unavailability of the items or services purchased. Cancellation and Refund Policy We offer cancellation and refund on any reservations made on the Platform in line with that particular Vendor's or Experience's cancellation and refund policies. Please refer to the particular Vendor's or Experience's terms. CrewScapes specific packages and services are non-refundable after time of purchase. Advance Payments We may ask you to provide an advance payment on any reservation made of Vendors or Experiences offered on the Platform. An advance payment is a partial or full payment of the total booking price of a Vendor or Experience. DISCLAIMER OF WARRANTIES YOU EXPRESSLY AGREE THAT ACCESS TO AND USE OF THE PLATFORM IS AT YOUR SOLE RISK. THE PLATFORM IS PROVIDED "AS IS". CREWSCAPES DOES NOT MAKE, AND HEREBY DISCLAIMS, ANY REPRESENTATIONS OR WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, REGARDING (A) THE PLATFORM; (B) ANY PRODUCTS AND SERVICES OFFERED THROUGH THE PLATFORM; AND (C) THE ACTS OR OMISSIONS OF USERS, VENDORS AND EXPERIENCES THROUGH THE PLATFORM, INCLUDING (WITHOUT LIMITATION) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, AND ANY WARRANTIES ARISING BY COURSE OF DEALING OR CUSTOM OF TRADE. CREWSCAPES MAKES NO REPRESENTATIONS OR WARRANTIES THAT YOUR ACCESS TO AND USE OF THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, FREE OF VIRUSES, MALICIOUS CODE, OR OTHER HARMFUL COMPONENTS, OR OTHERWISE WILL BE SECURE. Remedies You also agree that the remedy for breach of these Terms as it relates to your access to and use of the Platform will be to pursue dispute resolution as provided in these Terms below. These remedies are intended to be your sole and exclusive remedies for any breach of these Terms as it relates to your access to and use of the Platform. User Account When you provide your information to the Platform, you guarantee that you are eighteen (18) years of age or older and that the information that you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or out-of-date information may result in the immediate suspension or termination of your account on the Platform and being precluded from future use of the Platform. You are solely responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any activities or actions that occur under your account and/or password, whether your password is with the Platform or a third-party service. We will not be liable, and you may be liable for losses, damages, liability, expenses, and fees incurred by us or a third party arising from someone else using your account, regardless of whether you have notified us of such unauthorized use. We reserve the right to terminate your account anytime at our sole discretion. You can terminate your account by contacting us. Feedback Any submissions by you to us (e.g., comments, questions, suggestions, materials - collectively, "Feedback") through any communication whatsoever will be treated as both non-confidential and non-proprietary. Except as prohibited by applicable law, you hereby assign all right, title, and interest in, and we are free to use, without any attribution or compensation to you, any ideas, know-how, concepts, techniques, or other intellectual property and proprietary rights contained in the Feedback, whether or not patentable, for any purpose whatsoever, including but not limited to, developing, manufacturing, having manufactured, licensing, marketing, and selling. CrewScapes Privacy Policy Crewscapes LLC values your privacy and makes every effort to create a positive user experience. In certain instances, Crewscapes LLC may collect and use information that is provided to us. This Privacy Policy focuses on the collection, use, and disclosure of information that Crewscapes LLC may collect while you use the website, application, or other offerings supplied by Crewscapes LLC (collectively, the "Platform"). Unless otherwise stated, the terms that are used but not defined in this Privacy Policy have the same meanings as in the Crewscapes LLC Terms and Conditions. This Privacy Policy applies only to the Crewscapes LLC Platform and does not apply to any other platforms, applications, websites, services, or products provided by third parties that are not directly affiliated with Crewscapes LLC that you may visit (such as a link you click on through the Platform). The Privacy Policies of third-party platforms, applications, websites, services, or products are not controlled by Crewscapes LLC (even when we provide clickable links). To find out more about data security policies and privacy of third-party platforms, please visit their appropriate Privacy Policies as they may differ from Crewscapes LLC. Submitting your information to Crewscapes LLC and using the Platform assumes that you have read, understood, and agreed to Crewscapes LLC’s Privacy Policy, Crewscapes LLC's Terms and Conditions, and all other relevant Crewscapes LLC rules and policies (collectively, the "Agreement"). Additionally, this policy assumes that you give Crewscapes LLC consent to use your information as described in this Agreement. Should you disagree with any part of the Privacy Policy, then you should not access or use the Platform. To learn about the different types of information that Crewscapes LLC collects, how that information is used, what information is disclosed to third parties, and how Crewscapes LLC protects your information, please review this Privacy Policy regularly as Crewscapes LLC makes adjustments periodically. We will notify you of any changes to this Privacy Policy by posting the updated Privacy Policy to the Platform. The information that Crewscapes LLC collects is and will be subject to the Privacy Policy in effect at the time the information is gathered. 1. User Information Collected by Crewscapes LLC 1.1 Personal Information and Non-Identifying Information When using the Crewscapes LLC Platform, such as creating an account or registering as a user ("User"), you may be asked for personally identifiable information. This type of information is information that can be used to identify or contact you ("Personal Information"). Personal Information includes, but is not limited to, your full name, email address, and any other information that can be used by Crewscapes LLC to personally identify you. Crewscapes LLC also collects other information when registering as a User to administer and personalize your account that does not identify you ("Non-Identifying Information"). Such Non-Identifying Information includes, but is not limited to, individual preferences and your zip code (on its own). Specific Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (e.g., combining your preferences with your profile or zip code with your street address) in a way that enables you to be identified. However, the same pieces of information are considered Non-Identifying Information when taken alone or combined only with other non-identifying information (e.g., your birthday or your viewing preferences). The main reason Crewscapes LLC uses your Personal Information (in some cases with your Non-Identifying Information) is to communicate with you, to provide you with the functionality and the features of the Crewscapes LLC Platform, and to facilitate and complete vendor transactions for you when initiated by you. We may combine your Personal Information with Non-Identifying Information and other information we collect to provide you with an enhanced experience to improve the quality of the Crewscapes LLC Platform, and to analyze how the Platform is used by Crewscapes LLC Users. Another reason we may use your Personal Information is to contact you with marketing and promotional materials, periodic newsletters, targeting via social media platforms such as Meta, and provide you with other information that may be relevant to you. At all times, you may unsubscribe from Crewscapes LLC if you no longer wish to receive such communications. To unsubscribe, please follow the instructions in our communications (usually located at the bottom), or update your account settings. 1.2 Usage Data When you visit the Platform, whether you are logged in or just visiting without logging in, our servers automatically record information that your browser or device may send whenever you visit a website or use a similar application or online service. The information sent automatically by your device is referred to as "Usage Data." This Usage Data may include information such as the manufacturer and model of your device; your Internet Service Provider (ISP); your device's Internet Protocol ("IP") address (or other device identifier), browser type, and operating system; referring/exit pages; clickstream data; Platform access times and dates, pages or areas of the Platform that you visit, the time spent on those pages, and information you search for on the Platform; and other statistics. Usage Data also includes geolocation data. The Platform collects and uses geolocation data to provide you with a better experience, to improve the quality and value of the Platform, and to analyze and understand how the Platform is used. We use this information for technical administration of the Platform, including to monitor and analyze use of the Platform, to increase the functionality and user-friendliness of the Platform, and to better tailor the Platform to Users' needs. Usage Data may be non-identifying or it may be associated with you. Whenever we associate Usage Data with Personal Information, we will treat it as Personal Information. 2. Information Collection Crewscapes LLC collects and stores any and all information that you enter on the Platform and may use numerous techniques and technologies that are different from each other to collect Personal Information, Non-Identifying Information, and Usage Data. Crewscapes LLC may use pixel tags, log files, cookies, clear gifs, embedded scripts, and/or other technology used to monitor your use of the Crewscapes LLC Platform. 2.1 Forms and Questionnaires When registering as a User, creating a party, completing your User profile, requesting/initiating a transaction with a vendor, or communicating with other Users, vendors, or Crewscapes LLC, we request certain information from you through the use of various forms. 2.2 Cookies Cookies are text files with small pieces of data — like a username and password — that are used to identify your computer as you use a computer network. When a cookie is exchanged between your computer and the network server, the server reads the ID and knows what information it should specifically serve you. As cookies are regularly used by several websites, users will be prompted to accept cookies or decline them. Disabling cookies may limit certain features on the website, but that is up to the User's discretion. In our case, cookies are sent to and stored on your device from the Crewscapes LLC server. Crewscapes LLC receives insights on what parts of the platform are most used by (and how much time they are used for) through the use of cookies and similar technologies. One reason Crewscapes LLC uses cookies is to understand if a User is active and for additional business-related purposes. Crewscapes LLC may include different types of cookies. For example, first-party cookies are created and used on a single domain - they send data directly to Crewscapes LLC and agents and contractors (Vendors) acting on behalf of Crewscapes LLC These could also be cookies used to analyze, monitor and administer the Platform. An additional type of cookie that may be used to collect information is a third-party cookie. These cookies send data to our agents and contractors for their commercial use. Through the use of technology such as Google Analytics and other retargeting technology, Crewscapes LLC will track a User's activity and follow that user for up to the industry standard of 30 (thirty) days. Crewscapes LLC may also use retargeting software for its email service provider and other software such as Mailchimp, HubSpot Marketing Hub, and Salesforce Marketing Cloud. 2.3 Collected Usage Data Crewscapes LLC automatically collects the usage data on its servers and software. This means that your session on the Platform will be tracked due to the collected Usage Data when any User is on the Platform. By being on the Platform, the User agrees that Crewscapes LLC may collect and also use data (technical data and related information such as technical information). This information includes but is not limited to your device, system, application software, and peripherals, to maintain and support the Crewscapes LLC platform. We may also use pixel tags or clear gifs (tiny graphic images) so that we can measure the effectiveness of the searches that Users conduct, understand what parts of the Platform users have visited/seen, and allow us to understand what emails were sent and opened/unopened (ensuring that the emails we send are of interest to our Users). In some of those email messages, Crewscapes LLC may insert a clickable URL (also called a click-through URL) that is linked to content posted on crewscapes.my.canva.site. Should a User click on one of these URLs, that User will pass through the Crewscapes LLC server before arriving at the intended web page. To figure out if a user is interested in the specific content, and to measure the effectiveness of such User communications, Crewscapes LLC will track the click-through data. Any user can prevent tracking by not clicking on the text or graphic links received in emails from Crewscapes LLC 2.4 Tracking Opt-Out Some web browsers can be set to send "Do Not Track" signals to online services that you visit. Crewscapes LLC does not currently alter our practices when we receive a "Do Not Track" signal from a visitor's browser. If we do respond to "Do Not Track" signals in the future, we will update this Privacy Policy to describe the practice. Please be aware that the use of the Platform may be ineffective if "Do Not Track" signals are activated. Crewscapes LLC may also use Google Analytics to understand, analyze, and monitor the Crewscapes LLC platform for the purposes of the aforementioned goals. You may opt-out of having made your activity on the platform available to Google Analytics by installing the Google Analytics opt-out browser add-on. 2.5 External Vendors The Crewscapes LLC Platform may include third-party tools that send information to external vendors. These third-party tools may include software such as social media integrations, marketing automation services, and other similar tools. Crewscapes LLC is not responsible for the content, privacy policies, or practices of any third-party websites or tools. Users should be aware when they leave the Crewscapes LLC Platform and are encouraged to read the privacy policies of any website or tool they visit. This Privacy Policy applies only to information collected by Crewscapes LLC through the Platform. 3. Information Use Crewscapes LLC uses the information we collect to provide, maintain, and improve our Platform, and to provide and deliver the products and services you request, process transactions, and send you related information, including purchase confirmations and invoices. We may also use the information we collect to: Send you technical notices, updates, security alerts, and support and administrative messages; Respond to your comments, questions, and requests, and provide customer service; Communicate with you about products, services, offers, promotions, rewards, and events offered by Crewscapes LLC and others, and provide news and information we think will be of interest to you; Monitor and analyze trends, usage, and activities in connection with our Platform; Detect, investigate, and prevent fraudulent transactions and other illegal activities and protect the rights and property of Crewscapes LLC and others; Personalize and improve the Platform and provide advertisements, content, or features that match user profiles or interests. 4. Information Sharing Crewscapes LLC does not share your Personal Information with third parties except as described in this Privacy Policy or in connection with the Platform. We may share Non-Identifying Information, such as aggregate user statistics, demographic information, and Usage Data with third parties, including vendors, analytics providers, and other partners. We may share Personal Information with third-party vendors and service providers that perform services on our behalf, such as web hosting, payment processing, email delivery, marketing, and advertising, customer service, and other similar services. These third-party vendors and service providers may use your Personal Information only to perform services on our behalf and are obligated to protect the confidentiality and security of your Personal Information. Crewscapes LLC may also disclose your Personal Information if we believe it is necessary to: Comply with applicable laws, regulations, or legal processes; Protect the rights, property, and safety of Crewscapes LLC, our users, or others; Enforce our agreements, policies, and terms of use; Respond to claims that any content violates the rights of third parties; Prevent fraud or other illegal activities. 5. Data Security Crewscapes LLC takes reasonable measures to protect your Personal Information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. However, no security measures are perfect or impenetrable, and we cannot guarantee the security of your Personal Information. You are responsible for maintaining the confidentiality of your account information and for restricting access to your account. Crewscapes LLC will not be liable for any loss or damage arising from your failure to protect your account information. 6. Children's Privacy Crewscapes LLC does not knowingly collect or solicit Personal Information from children under the age of 13. If we become aware that we have collected Personal Information from a child under 13, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us. 7. Changes to the Privacy Policy Crewscapes LLC may update this Privacy Policy from time to time. We will notify you of any changes by posting the updated Privacy Policy on the Platform. You are advised to review this Privacy Policy periodically for any changes.
